Plant murder sentencing now set for Jan. 25

A Richmond man convicted of murder will not be sentenced until late January after a continuance was granted.

The sentencing hearing for Deandre Plant, 21, now is set for 9 a.m. on Jan. 25 in Wayne County Superior Court I. It had been scheduled for 9 a.m. Monday.

After Plant was convicted on Dec. 10 by a Wayne County jury, Todd gave defense counsel Austin Shadle the option between Monday's date and the Jan. 25 date, which would have required Plant's waiving of his right to be sentenced within 30 days. Shadle chose Monday's option at the time.

However, on Dec. 14, he filed a motion to delay the sentencing. On Thursday, Todd granted the continuance and scheduled the Jan. 25 hearing.

Plant's murder conviction carries a sentencing range of 45 to 65 years in prison, with an advisory sentence of 55. The jury deliberated for about three hours on the fourth day of Plant's trial before returning the guilty verdict.

He is the second co-defendant found guilty by a jury in the May 2014 killing of Caleb Woosley, 17,  with aluminum baseball bats. Two other co-defendants reached plea agreements with the Wayne County Prosecutor's Office.

Kore Buchanan, 18, is in the Indiana Department of Correction's Reception Diagnostic Center after a jury found him guilty on Oct. 1 of murder. Todd sentenced him on Oct. 21 to 58 years in prison and two years of probation.

Michael Pruitt, 18, is in the Pendleton Correctional Facility serving a 45-year prison sentence for murder. He reached a plea agreement that also includes 10 years of probation.

David Maish, 19, is in the Wayne County Jail serving a 180-day sentence for contempt of court resulting from his behavior as a witness during Buchanan's trial. He also has a Feb. 16 trial scheduled on a petition to revoke probation filed by the Wayne County Probation Department because of the contempt charge.

Maish reached a plea agreement that sentenced him to two years in prison and six years of probation for a Class C felony charge of assisting a criminal in the Woosley case.
